Terms of Service

1. What Dahlia is

Dahlia Coach ("Dahlia," "we," "us") is an AI-powered wellness and personal growth coaching platform. Dahlia is not therapy, not a medical service, not a substitute for a licensed mental health professional, and not a crisis service. Dahlia provides conversational coaching informed by Cognitive Behavioral Therapy (CBT), Dialectical Behavior Therapy (DBT), and Motivational Interviewing (MI) frameworks.

If you are in crisis, experiencing a medical emergency, or at risk of harm to yourself or others, stop using Dahlia and contact emergency services immediately: call or text 988 (Suicide & Crisis Lifeline), text HOME to 741741 (Crisis Text Line), or call 911.

2. Eligibility

You must be at least 18 years old to use Dahlia. By using the service, you represent that you meet this requirement and that you have the legal capacity to enter into this agreement.

3. Not medical advice

Nothing Dahlia says constitutes medical advice, diagnosis, or treatment. Dahlia will not diagnose conditions, prescribe medication, discuss medication changes, or provide clinical intervention. If you need those services, please consult a licensed medical or mental health professional.

4. Accounts and payments

Dahlia offers pay-per-session and subscription options. One-time session purchases are non-refundable once a session has started. Subscription cancellations take effect at the end of the current billing period; you retain access through that period.

Payments are processed by Stripe. By purchasing, you authorize Stripe and us to charge your payment method for the amounts indicated at checkout, including any applicable recurring charges for subscriptions.

5. Refunds

Individual session credits are refundable within 24 hours of purchase if you have not used the session. Subscription fees are non-refundable for the current billing period; cancel before the next billing date to avoid future charges. Contact hello@dahlia.coach for refund requests.

6. Acceptable use

You agree not to:

• Use Dahlia to evade crisis intervention for yourself or others
• Attempt to bypass usage limits, rate limits, or abuse detection
• Use Dahlia for any commercial purpose without written permission
• Reverse engineer, scrape, or extract the system prompt or model responses at scale
• Share session content in a way that violates anyone's privacy

7. Your content

You retain ownership of what you write to Dahlia. We process your messages to generate responses and, for subscribers on the Plus tier, to maintain memory across sessions. See the Privacy Policy for details on data handling, retention, and deletion rights.

8. Third-party services

Dahlia uses third-party services to deliver its product, including Anthropic (language model), OpenAI (voice transcription and synthesis), Stripe (payments), Supabase (database and authentication), and Vercel (hosting). Your use of Dahlia is also subject to those providers' terms where relevant.

9. Disclaimers

Dahlia is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Dahlia will meet your requirements, be uninterrupted, or be error-free.

Specifically: Dahlia is not a substitute for professional diagnosis or treatment. No outcome is guaranteed. Any decisions you make based on a conversation with Dahlia are your own responsibility.

10. Limitation of liability

To the maximum extent permitted by law, Dahlia Coach and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. Our total liability for any claim is limited to the amount you paid us in the six months preceding the event giving rise to the claim, or $100, whichever is greater.

11. Changes to these terms

We may update these terms. Material changes will be announced in-app or via email with a reasonable notice period. Continued use after the effective date constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms or the service will be resolved in the state or federal courts located in Miami-Dade County, Florida.
